Terms of sale

This English translation is provided for convenience. The French version is the only legally binding version.

1. Purpose

These general terms and conditions govern sales concluded on the King Watch website between Obrad Berdegay, sole trader (micro-entreprise), SIRET 999 423 569 00014, and any consumer purchaser. Placing an order constitutes unreserved acceptance of these terms and conditions.

2. Products

The essential characteristics of each item are set out on its product page. The photographs are as faithful as possible but do not constitute a contractual commitment as to shades of colour, which may vary depending on the screen.

3. Prices

Prices are stated in euros, inclusive of all taxes, excluding delivery charges. VAT is not applicable pursuant to Article 293 B of the French General Tax Code (Code général des impôts). Delivery charges are stated before the order is finally confirmed. We reserve the right to change our prices at any time, it being understood that the applicable price is the one displayed at the time of the order.

4. Orders

The sale is concluded when the purchaser confirms the order after checking its details and total price, and confirms payment. A confirmation email summarising the order is then sent to the purchaser.

5. Payment

Payment is due in full at the time of ordering, by bank card or by the other methods offered at checkout. Transactions are secured by our payment service provider. We do not store any bank details.

6. Delivery

Delivery terms and times are detailed in our shipping policy. If the announced delivery deadline is exceeded, the purchaser may, after having given the seller formal notice to perform within a reasonable period, terminate the contract and obtain a refund of the sums paid, in accordance with Article L.216-6 of the French Consumer Code.

7. Right of Withdrawal

The purchaser has fourteen days from receipt to exercise the right of withdrawal without having to give any reason. The procedure is set out in our refund policy.

8. Legal guarantees

All our products are covered by the legal guarantee of conformity (Articles L. 217-1 to L. 217-32 of the French Consumer Code) and by the legal guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code). To use them, email us at contact@kingwatch.fr with your order number.

The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only needs to establish the existence of the lack of conformity, not the date on which it appeared.

Where the sales contract provides for the continuous supply of digital content or a digital service for more than two years, the legal guarantee applies to that digital content or service throughout the planned supply period. During this period, the consumer only needs to establish the existence of the lack of conformity affecting the digital content or service, not the date on which it appeared.

The legal guarantee of conformity obliges the professional, where applicable, to provide all updates needed to keep the goods in conformity.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests a repair but the seller imposes a replacement, the legal guarantee of conformity is renewed for two years from the date of replacement.

The consumer may obtain a reduction of the purchase price while keeping the goods, or end the contract and obtain a full refund against return of the goods, if:
1. The professional refuses to repair or replace the goods;
2. The repair or replacement takes place after thirty days;
3. The repair or replacement causes a major inconvenience for the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the installation costs of the repaired or replacement goods;
4. The lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to request repair or replacement first.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are unavailable for repair or replacement suspends the remaining guarantee period until the goods are returned in working order.

The rights mentioned above result from Articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who obstructs in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.

9. Liability

Our products are fashion items made of stainless steel, alloy or leather, and quartz watches. They are not diving instruments. Unless expressly stated otherwise on the product page, they are not water-resistant and must not be immersed.

10. Personal Data

11. Governing Law and Disputes

These terms are governed by French law. In the event of a dispute, the buyer may refer the matter free of charge to the consumer mediator CM2C, 49 rue de Ponthieu, 75008 Paris, France, online at www.cm2c.net.
